Is a third party covered under HIPAA if they receive authorized patient information?
If a patient signs a consent form to a third party, for example, to an attorney, is that patient information protected under HIPAA? What is stopping the third party from sharing the information from that point on?
Answer
A good place to begin a search for information is the US Department of Health and Human Services' webpage on HIPAA. In particular, you might want to visit:
- Covered Entities and Business Associates
Pay close attention to the first paragraph, which defines the responsibilities for a covered entity before it can relay information to a business associate. - HIPAA FAQs for Professionals
The library's eBooks and Academic eBooks collection includes several titles on HIPAA. Type HIPAA in the search box, then click search to view eBook selections.
